Bareboat Charter Agreement
This bareboat charter agreement, entered into on the agreed day according to booking confirmation, is between the “CHARTERER” and the “OWNER,” The Electric Voyage, Inc., a California corporation. Effective Date of Agreement: This Agreement shall be deemed executed by the OWNER on the same date it is signed by the CHARTERER.
Bareboat Charter: A bareboat charter is a lease arrangement where the CHARTERER assumes all rights and obligations of ownership of the BOAT during the charter period without transfer of title. The CHARTERER has full possession, command, and navigation control of the BOAT and accepts all responsibility for operation and safety of the BOAT and its passengers.
READ THIS AGREEMENT CAREFULLY. BY SIGNING, THE CHARTERER RELEASES THE OWNER, OWNER’S AGENTS, CONTRACTORS, SUCCESSORS, HEIRS, EXECUTORS, ADMINISTRATORS, AND REPRESENTATIVES AGAINST ALL CLAIMS OR DAMAGES ARISING OUT OF THE USE OF THE BOAT. THE CHARTERER AGREES TO INDEMNIFY THE OWNER AGAINST ANY CLAIMS BASED UPON THE CHARTERER’S USE OF THE BOAT.

Charter Terms
Charter Period & Return
The CHARTERER agrees to charter the BOAT for the agreed-upon time and date according to booking confirmation. A 5-minute grace period is allowed for late returns. After that, a late fee of $3 per minute will apply until the BOAT is returned.

The BOAT may not be left unattended or abandoned. The CHARTERER must return the BOAT directly to an authorized Electric Voyage representative at the end of the charter period.

Payment
The CHARTERER agrees to pay the total agreed amount per the booking confirmation. -
Boat Usage
The CHARTERER has full command, navigation, and possession of the BOAT during the charter period. The OWNER does not provide a captain or crew. -
Driver Assignment & Liability

The CHARTERER must be present on the BOAT at all times during the charter. The CHARTERER may permit another qualified DRIVER (age 21+, sober, and capable) to operate the BOAT. However, the CHARTERER remains fully and solely responsible for the BOAT, its safe operation, and all persons aboard, regardless of who is at the helm.

Communication & Orientation
The OWNER may provide a brief orientation and will remain available by phone for emergency contact only. OWNER staff will not operate or control the BOAT during the charter. -
Cleaning Responsibilities
The CHARTERER must remove all trash and ensure guests disembark at the agreed-upon return time. -
Security of Boat
The CHARTERER is responsible for securing and properly tying the BOAT upon return.
Indemnification & Liability

The CHARTERER assumes full responsibility for the BOAT, its operation, and all persons aboard during the charter. The CHARTERER agrees to indemnify and hold harmless the OWNER and its representatives against any suits, claims, demands, or damages arising from operation or use of the BOAT.
Acceptable Use

CHARTERER must be 18 or older.

DRIVER (operator) must be 21 or older, sober, and capable.

CHARTERER may designate another DRIVER, but CHARTERER remains fully responsible.

All safety rules and navigation laws must be followed.

Unsafe operation, as determined by OWNER, may result in termination of the charter.

Children under 13 must wear life vests at all times.

No smoking, drugs, fishing, or swimming.

Remain within Marina del Rey Harbor; avoid rocks, walls, and debris.

Dock only in designated areas or in emergency.

Anchoring not permitted in the marina.

Navigation lights must be used at sunset.

No littering; avoid wildlife interaction.

Call 911 in emergencies.
Legal Provisions

Severability: Invalid provisions do not affect the remainder.

Force Majeure: OWNER not liable if unable to provide BOAT due to circumstances beyond control.

Arbitration: Disputes resolved by binding arbitration under the AAA.

Legal Fees: CHARTERER responsible for OWNER’s legal fees in disputes.

Counterparts: Agreement may be executed electronically.
Signatures

The CHARTERER agrees to all terms above and acknowledges assumption of full control, command, and responsibility for the BOAT during the charter.
